Confidentiality, agreed by contract and backed by criminal law.

We take part in your professional work as a service provider under section 43e of the Federal Lawyers’ Act (BRAO). As a contributing person (mitwirkende Person) within the meaning of section 203 (3) of the German Criminal Code (StGB), we are therefore ourselves bound by the criminal-law duty of confidentiality in section 203 (4) StGB.

What every engagement includes.

  • Confidentiality agreement under section 43e BRAO

In text form, with notice of the criminal consequences of a breach. It also sets out which further service providers may be involved.

  • Data processing agreement under Article 28 GDPR

We process personal data only on your instructions. We delete all files no later than 30 days after the engagement ends. At your request, we return them to you before then.

  • A ready consent clause

For your clients’ consent under section 43e (5) BRAO, you receive a clause you can adopt in your engagement terms.

Placeholders before any AI processing.

The placeholders name the role, such as [MANDANT] or [ZEUGE 1], so the drafts stay readable.

We compile the list of names for each matter from the file. A checking tool also catches spelling variants, text recognition errors and identifiers that follow fixed patterns.

AI providers receive only the version with placeholders. The mapping between names and placeholders stays with us. The Word files we deliver carry the real names again.

We transcribe spoken dictations on our own computer and replace the names before any AI provider receives them.

  1. Handover

Witness Max Mustermann confirms receipt of the notice of defects.

You send the case file by email.

  2. Placeholders

Witness [ZEUGE 1] confirms receipt of the notice of defects.

Before any AI system processes the file, we replace names and identifiers such as IBANs, email addresses, telephone numbers, case numbers and dates of birth with placeholders.

  3. Processing

Witness [ZEUGE 1] confirms receipt of the notice of defects.

The AI agents see only the version with placeholders. The AI providers do not use the material to train their models.

The AI providers do not receive this mapping.

If you replace the names yourself.

You can also replace names and identifiers with placeholders yourself before you send the file. We then work with your placeholders and return the documents with the same placeholders. In that case the mapping never leaves your firm.

Sending by email.

You send the case file by email to luca@orlyn.ai.

Who works on the file.

Luca Diaz Hilterscheid is personally responsible for every engagement. He selects, configures and operates the third-party AI systems and runs defined technical checks.

What is checked before every delivery.

  • Citations

Every cited decision and statute is confirmed at the primary source. Anything that cannot be confirmed is removed.

  • Metadata

Delivered files contain no outside author names and no hidden text.

  • Visual check

Every page of every delivered document is rendered and checked visually.

  • One complete version

Every revision comes back as a complete package. A list shows changed and unchanged components.
